Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the ArcaneAPI platform, website, API endpoints, documentation, or any associated services (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

ArcaneAPI operates as a unified API gateway that provides programmatic access to artificial intelligence models from multiple third-party providers, including but not limited to OpenAI, Anthropic, Google, Mistral AI, Meta, Stability AI, and others. The Service includes:

  • API endpoints for chat completion, image generation, video generation, audio processing, embeddings, and code generation
  • A web-based developer dashboard for account management, API key management, usage analytics, and billing
  • Technical documentation and code examples
  • Email notifications related to account activity, usage alerts, and product updates

ArcaneAPI acts as an intermediary between you and the underlying model providers. We do not develop or train the AI models accessible through our platform.

3. Account Registration and Eligibility

To use the Service, you must register an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information to keep it accurate
  • Maintain the confidentiality of your account credentials and API keys
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age or the age of legal majority in your jurisdiction. Accounts registered by automated methods (bots) are not permitted.

4. API Keys and Authentication

API keys are sensitive credentials equivalent to passwords. You are solely responsible for safeguarding your API keys. You must not share, publish, or commit API keys to version control systems, client-side code, or publicly accessible locations.

ArcaneAPI stores API keys as irreversible SHA-256 hashes. We cannot recover lost keys — you must generate new ones. You may revoke API keys at any time through the dashboard. We reserve the right to revoke API keys that we believe have been compromised or are being used in violation of these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Generate child sexual abuse material (CSAM) or any content exploiting minors
  • Develop weapons, engage in surveillance, or facilitate violence
  • Distribute malware, spam, or phishing content
  • Circumvent rate limits, authentication mechanisms, or security measures
  • Reverse-engineer, decompile, or attempt to extract source code or model weights from the Service
  • Resell API access without written authorization from ArcaneAPI
  • Use the Service in a manner that could damage, disable, or impair its functioning

You are additionally bound by the acceptable use policies of the underlying model providers (e.g., OpenAI Usage Policies, Anthropic Acceptable Use Policy). Violations of upstream provider policies may result in immediate suspension.

6. API Usage and Rate Limits

API requests are subject to rate limits based on your account tier. Current limits are published on the Pricing page and may be adjusted. We may throttle or temporarily restrict access to maintain service stability. Sustained or repeated abuse of rate limits may result in account suspension.

7. Billing and Payment

The Service operates on a prepaid credit model. You purchase credits in advance, and usage is deducted based on the per-model pricing published on our Pricing page. Key billing terms:

  • ArcaneAPI applies zero markup on provider token pricing. A transparent processing fee applies to credit top-ups.
  • Usage charges are calculated in real time based on actual token consumption, image generations, video seconds, or other applicable metrics
  • Credits are non-refundable except where required by applicable law
  • Pricing may change with 30 days' written notice. Existing credit balances will be honored at the rates applicable when the credits were consumed.
  • Accounts with zero balance will not be able to make API requests until credits are added

8. Email Communications and Consent

During registration, you may opt in to receive email communications including product updates, model announcements, usage alerts, and weekly usage reports. Email consent is:

  • Explicit and voluntary — opt-in is never pre-selected or required for account creation
  • Granular — you may independently control notifications, usage alerts, and marketing emails
  • Revocable — you may withdraw consent at any time via account settings or the one-click unsubscribe link included in every email

We may send transactional emails (email verification, password resets, security alerts, and critical service notices) regardless of your marketing preferences, as these are necessary for the operation and security of your account. All emails comply with CAN-SPAM, GDPR, and applicable anti-spam regulations.

9. Data Handling

ArcaneAPI does not store, log, or retain the content of your API requests or responses. We log only operational metadata necessary for billing and service operation, including: model identifier, token counts, response time, status code, timestamp, and associated cost. 10. Intellectual Property

You retain all rights to the input you provide to and the output you receive from the AI models through our Service, subject to the intellectual property policies of the underlying model providers. ArcaneAPI does not claim ownership of your content.

The ArcaneAPI name, logo, website design, documentation, and all related intellectual property are owned by ArcaneAPI. You may not use our trademarks without prior written consent.

11. Third-Party Services

The Service relies on third-party infrastructure and model providers. We are not responsible for the availability, accuracy, or policies of third-party services. Model availability may change without notice if an upstream provider modifies or deprecates their offerings. We will make reasonable efforts to communicate such changes in advance.

12. Service Availability and SLA

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. Enterprise customers may negotiate specific Service Level Agreements with defined uptime guarantees and remedies.

13. Termination

You may terminate your account at any time by deleting it through the Settings page. Account deletion will immediately:

  • Revoke all active API keys
  • Delete your personal information as described in our Privacy Policy
  • Forfeit any remaining credit balance

We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a risk to the Service or other users. Where possible, we will provide notice and an opportunity to remedy the violation before termination.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARCANEAPI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI MODEL OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR BIASED, AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR CRITICAL DECISIONS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCANEAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ARCANEAPI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless ArcaneAPI, its officers, directors, and employees from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email (if you have opted in) or a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
